Felony Assault Won at Preliminary Examination

Our client was charged with assault and weapons offenses for allegedly discharging a shotgun at a vehicle that was “turfing” (doing threatening burn-outs) in client’s driveway.


The Law Office of Michael Horowitz challenged the accusations at the preliminary examination. Attorney Horowitz showed that the “bullet hole” in the vehicle was smaller than what would be expected from client’s shotgun. Attorney Horowitz also successfully challenged the arresting officer’s testimony by proving that the officer’s testimony was different than his on-scene commentary. The district court refused to bind client over to the circuit court and the felony was dismissed.
